PROPCYCLE TERMS & CONDITIONS
Effective Date: 7 November 2025
These Terms and Conditions (“Terms”) govern your use of the services provided via PropCycle.com.au (“Platform”). By creating a Member account or using any PropCycle product or service, you agree to be legally bound by these Terms. If you do not agree, do not use the Platform.
CONTRACTING ENTITY
The Platform is operated by PropCycle Pty Ltd (ACN 690 408 836). This is the entity with which you enter into a contractual relationship.
WARRANTIES & CONSUMER GUARANTEES
If you are a consumer under the Australian Consumer Law (ACL), you have guarantees that cannot be excluded, including that services will be provided with due care and skill. Nothing in these Terms limits these rights.
To the extent permitted by law, we exclude all other warranties. PropCycle acts as a conduit for property information. We do not verify third-party information and recommend that Members independently verify all property data.
LICENSING & LEGAL STATUS
PropCycle does not act as a real estate agent, buyer’s agent, or any other licensed intermediary. We do not represent Members in property negotiations, provide recommendations, or make introductions.
We act solely as a facilitator in collecting property information already publicly available or available for clients. Clients instruct us to contact agents and other parties to request specific data aligned to their stated requests. All communications are initiated on their behalf in a non-representative capacity.
PropCycle has reviewed real estate licensing requirements across Australian states and territories and has structured its services accordingly. We will adjust operations in the event of regulatory change.
PropCycle is not licensed to provide financial services or financial product advice under the Corporations Act 2001 (Cth). We do not advise on property as an investment, asset class, or financial product. Users must seek independent licensed advice before making any financial decisions regarding property purchases.
INTELLECTUAL PROPERTY
You retain ownership of any Briefs or property requests. By submitting content, you grant us a non-exclusive, revocable, royalty-free licence to use your content solely for delivering services.
LIMITATION OF LIABILITY
Nothing in these Terms limits liability under the ACL.
To the extent permitted by law:

PropCycle is not liable for indirect, incidental or consequential loss

Total liability is limited to the subscription or service fee paid in the prior 30 days
No indemnity is required from Users.
DISPUTE RESOLUTION & GOVERNING LAW
Disputes must first be submitted to hello@propcycle.com.au. We aim to resolve within 14 business days. If unresolved, both parties agree to attend online mediation via the Resolution Institute before any court proceedings. Court action is limited to circumstances where mediation fails. Jurisdiction is Queensland, Australia.
TERMINATION
We may suspend or terminate your access if you:

Breach these Terms;

Use the platform to mislead PropCycle or users;

Attempt to reverse-engineer or interfere with our platform.
FORCE MAJEURE
PropCycle is not liable for delays or failures caused by events outside our reasonable control, including internet outages, legal restrictions, infrastructure failure, natural disaster, pandemic, or discontinuation of third-party platforms. If critical infrastructure becomes unavailable, we will suspend billing and pause subscriptions. If not resolved within 7 business days, services may be paused indefinitely or replaced.

MISCELLANEOUS

Severability: If any part of these Terms is found to be invalid or unenforceable, the remaining parts remain in effect.

Variation: We may update these Terms with 14 days’ notice via email or dashboard alert. Continued use of the Platform constitutes acceptance.

Assignment: We may assign or transfer these Terms in the event of a business restructure, merger, or acquisition. You may not assign your rights without written consent.
